1. Acceptance of Terms

By accessing or using NotNoise ("we," "our," or "us") at www.notnoise.co (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

NotNoise is an all-in-one music marketing platform that provides:

  • Smart link creation for music distribution
  • Spotify playlist pitching services
  • Facebook/Meta advertising campaign management
  • Analytics and insights
  • Email capture for fan engagement
  • Social media asset generation

3. User Accounts

Account Creation

  • You must provide accurate, complete, and current information
  • You are responsible for maintaining the confidentiality of your account
  • You are responsible for all activities under your account

Account Requirements

4. Facebook/Meta Integration

Authorization

By connecting your Facebook account, you authorize NotNoise to:

  • Create and manage advertising campaigns on your behalf
  • Access advertising account information
  • Retrieve analytics and performance data
  • Post content to your connected Pages (with your permission)

Compliance

You agree to comply with:

  • Facebook's Terms of Service
  • Facebook's Advertising Policies
  • Facebook's Community Standards
  • All applicable Meta platform policies

Advertising Responsibility

  • You are responsible for the content of your advertisements
  • You must ensure all ad content complies with applicable laws
  • You must have rights to all content used in advertisements
  • NotNoise is not liable for rejected or suspended ad campaigns

5. Acceptable Use Policy

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Attempt to gain unauthorized access to our systems
  • Use the Service for spam or unsolicited messages
  • Impersonate another person or entity
  • Sell or transfer your account
  • Use the Service for any illegal or unauthorized purpose

6. Content and Intellectual Property

Your Content

  • You retain all rights to your music and content
  • You grant us a license to use your content to provide the Service
  • You represent that you have all necessary rights to your content
  • You are responsible for your content's legality and accuracy

Our Content

  • The Service and its original content are protected by copyright
  • Our trademarks and trade dress may not be used without permission
  • You may not copy, modify, or distribute our Service
  • You may not reverse engineer or attempt to extract source code

7. Payment Terms

Subscriptions

  • Subscription fees are billed in advance
  • All fees are non-refundable except as required by law

  • You can cancel your subscription at any time

Payment Processing

  • You agree to Stripe's terms and conditions
  • You must provide accurate payment information

We do not guarantee:

  • Playlist placements
  • Advertising campaign approval or performance
  • Specific results from using the Service
  • Uninterrupted or error-free service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for the Service
  • We are not liable for lost profits or revenues
  • These limitations apply regardless of the theory of liability

11. Indemnification

You agree to indemnify and hold NotNoise harmless from any claims arising from:

  • Your use of the Service

  • Your content or advertisements
  • Your violation of any rights of another party

  • We do not sell your Facebook data
  • We use data solely to provide the Service
  • You can disconnect Facebook access at any time

  • You must have rights to promote the music
  • You must comply with advertising standards
  • You must maintain accurate artist information
